The Instratify Group Inc. (“Instratify”/“we”/”us”/”our”) is committed to protecting your privacy. This Privacy Policy applies to Instratify and to instratify.com (the “Site”) through which we provide our growth and innovation consulting, newsletter, and online training (the “Service”). This Privacy Policy describes how we collect, store, use and distribute Personal Information (as defined below) of our Users collected through the Site and the Service
CONSENT
By using the Site or the Service you consent to the use of your Personal Information as outlined in this Privacy Policy. Your Personal Information will not be used for any purposes other than those described herein. We will not actively collect Personal Information for the purpose of sale or marketing in a way that identifies you personally. You may withdraw your consent to our use of your Personal Information at any time. However, withdrawing consent may result in your inability to continue using the Site and the Service. Except as otherwise stated herein, this Privacy Policy applies to all of the Personal Information of yours that Instratify has on record.
COLLECTION OF INFORMATION
Instratify collects, uses and discloses only such Personal Information as is required to manage User accounts, to provide the Service, to maintain our customer lists, to respond to User inquiries, for the identification and authentication of Users, for the improvement of the Service, and as required to comply with applicable laws and the requests of law enforcement. Unless otherwise agreed (and subject to any exclusions and disclosures described herein) we will not disclose your Personal Information to any third parties.
This Privacy Policy does not address the collection, use or disclosure of the following types of information, the collection of which is not restricted by applicable laws: (a) information that is publicly available; and (b) Non-Personal Information (as defined below).
“Personal Information” is personally identifiable information, such as your name, address, e-mail address and birth date. Instratify collects and stores some Personal Information relating to your account registration, your communications between you and Instratify, your use of the Service and of customer support. Instratify may share information relating to your use of the Service with trusted third parties to help perform statistical analyses or to improve customer support. All such third parties are prohibited from using your Personal Information except to provide these services to Instratify, and they are required to maintain the confidentiality of your information.
“Non-Personal Information” is non-personally identifiable information, such as your internet protocol address (IP Address), the domain used to access the Site, and aspects of the hardware and software of the device from which you access the Site and the Service. It also includes aggregated information, such as demographic statistics (e.g. average age or geographic distribution of our Users) and anonymized information relating to Users’ use of the Service.
Although the use of certain Non-Personal Information collected, used or disclosed through the internet as described herein is not restricted (and to the extent that such is the case, the obligations under this Privacy Policy do not apply to such information), we provide information in this Privacy Policy about the collection of such information for the sake of transparency. Such Non-Personal Information may be collected or derived by Instratify through the Site and the Service.
USE OF INFORMATION
Instratify collects Personal Information for the following purposes:
- Registration Information: We collect some Personal Information when you create an account with the Service or signup for our email newsletter, such as your name and email address.
- Transactional Notifications: We provide notice to Users of certain occurrences or updates relating to the Service, for example, we may send you notification of updates to our Privacy Policy or Terms of Use. Certain transactional notifications are optional but receiving updates to our Privacy Policy and Terms of Use are not optional.
- Marketing Communications: You may opt-in to receive certain communications from us which are not Transactional Notifications and may include details of new products, services, features or news from Instratify and its partners which we think may be of interest to you. You may withdraw your consent to receiving such emails from us at any time by following the opt-out instructions in any such emails, or by contacting Instratify with your request to info@instratify.co.
- Statistics: Instratify may use information about your use of the Service for statistical purposes. This could include data relating to your use of various features of the Service. This information is kept confidential. However, aggregate statistics that incorporate such data and that do not personally identify an individual User may be shared with trusted third parties.
- Hardware & Software Information: Instratify collects some information on the hardware and software of the device through which you access the Site and the Service, such as screen size, operating system version, etc.
If we plan to use your Personal Information in the future for any other purposes not identified above, we will only do so after informing you by updating this Privacy Policy or by notifying you by other means. See further the section of this Privacy Policy entitled ‘AMENDMENTS TO THIS POLICY’ below.
DISCLOSURES & TRANSFERS
We have put in place contractual and other organizational safeguards to ensure a proper level of protection of your Personal Information (see further ‘SECURITY’ below). In addition to those measures, we will not disclose or transfer your Personal Information to third parties without your permission, except as specified in this Privacy Policy (see further ‘Important Exceptions’ below).
We use servers that are located in Canada and the United States and accordingly your Personal Information may be available to the Canadian and United States governments or [its/their] respective agencies under a lawful order, irrespective of the safeguards we have put in place for the protection of your Personal Information.
From time to time we may employ third parties to help us improve the Site and/or the Service. These third parties may have limited access to databases of Users’ Personal Information solely for the purpose of helping us to improve the Site and/or the Service and they will be subject to contractual restrictions prohibiting them from using the information about our Users for any other purpose.
Important Exceptions
- We may disclose your Personal Information without your consent if required to do so by law or in the good-faith belief that doing so is necessary to: (i) conform to the law or to comply with legal process served on Instratify; (ii) protect and defend the rights or property of Instratify; (iii) to identify, contact or bring legal action against someone who may be (either intentionally or unintentionally) causing injury to or interference with our rights or property or the rights or property of Users of the Service; and (iv) act under exigent circumstances to protect the personal safety of our Users or the general public.
- We may also disclose your Personal Information in connection with a corporate re-organization, a merger or amalgamation with another entity, a sale of all or a substantial portion of our assets or stock, including any due diligence exercise carried out in relation to the same, provided that the information disclosed continues to be used for the purposes permitted by this Privacy Policy by the entity acquiring such information.
SECURITY
The security of your Personal Information is important to us. We use commercially reasonable efforts to store and maintain your Personal Information in a secure environment. We take technical, contractual, and administrative security measures in order to protect the Personal Information that you provide to us. We have implemented procedures designed to limit the dissemination of your Personal Information to only such designated staff as are reasonably necessary to carry out the stated purposes we have communicated to you. You are also responsible for helping to protect the security of your Personal Information, for example, by never sharing your username and password for the Service to anyone else.
CHILDREN’S PRIVACY
The Site and the Service are not intended for use by persons under the age of 13. We do not knowingly collect information about persons under the age of 13. If you think we have collected such information, please contact us and we will remove such information from our systems.
RETENTION
We will keep your Personal Information for as long as necessary for the purposes identified herein or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain information as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained Personal Information will remain subject to the terms of this Privacy Policy. Even if you request that we do so, it may not be possible for us to completely delete all of your Personal Information due to technological and/or legal constraints.
AMENDMENTS TO THIS POLICY
We reserve the right to change this Privacy Policy at any time without notice to you. However, if we decide to change this Privacy Policy in the future we will endeavour to notify you of such change either by email or by other means. The latest version of this Privacy Policy will always be available at [instratify.co/privacy]. Any non-material changes (such as clarifications) to this Privacy Policy will become effective on the date that the revised policy is posted and made accessible to Users. Any material changes will become effective on the earlier of: (i) thirty (30) days from the date that the revised policy is posted and made accessible to Users, or (ii) when the User’s express consent to the revised policy is given to Instratify. The materiality of changes to this Policy is the exclusive determination of Instratify.
The date on which the latest revision was made to this Privacy Policy is indicated at the top of this document. We recommend that you print a copy of this Privacy Policy for your reference and revisit this webpage from time to time to ensure you are aware of any changes. Your continued use of the Service signifies your acceptance of any changes to this Privacy Policy.
ACCESS AND ACCURACY
Upon receipt of a written request from you, we will provide you with a copy of what Personal Information of yours that we have on file. We will endeavor to deal with all requests for access and modifications in a timely manner. To avoid delays in obtaining a record of your Personal Information, please provide sufficient detail to permit us to identify you and the specific information that you are requesting. Please note that in certain limited circumstances we may not be able to make all relevant information available to you, such as where the requested information also pertains to another User or other third party or where it contains confidential commercial information. In such circumstances we will provide the reasons for the denial of your request.
We will make every reasonable effort to keep your Personal Information accurate and up-to-date, and we will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate. As appropriate, such amended Personal Information will be transmitted to those parties to which we are permitted to disclose your Personal Information in accordance with this Privacy Policy. Having accurate Personal Information about you enables us to provide you the best possible service.
